Protect Yourself Before You Wreck Yourself?! It’s Not Just About The Money…

With so much exuberance regarding Name, Image, and Likeness (NIL) opportunities, the need to protect same should not be overlooked. As there is no structure at present to act as guardrails for NIL, it is of utmost importance that the athlete understand that safeguarding the ‘Privacy Rights’ associated with it and the promises extended is as important as getting the best offer commensurate with his/her value. The unfortunate consequence of having no structure is that it invites opportunism that could severely tarnish one’s name, image, or likeness to the point where others are enriched at the expense of the athlete’s reputation, and/or culminate in agreements unfulfilled. Therefore, ASE advises athletes to carefully assess their prospective representation’s knowledge of the present landscape, unstructured as it is currently, and the requisite preemptive safety measures and remedies available to them.
